Government

In 2019, the government ran a public consultation that sought feedback about the current legislation on sexual harassment in the workplace. The main findings of the consultation were that many were supportive of a new preventative duty to prevent harassment.

Following the public consultation, the government set out intentions to introduce a preventative duty requiring employers to prevent sexual harassment which will encourage employers to take positive proactive steps to make the workplace safer for everyone. Additionally, they commit to introducing explicit protections from third-party harassment. Introducing new legislation will motivate employers to make improvements to workplace practices and culture.

Employers

Following the disappearance of Suzy in 1986, Suzy Lamplugh Trust has pioneered personal safety as a public policy priority. Its vision is a society in which people are safer – and feel safer - from violence, aggression and abuse.

Employers have a duty to assess risks to all workers and take steps to avoid or control risks where necessary. It is imperative that employers have a personal safety policy in place that sets out guidance on staying safe, reporting incidents of harassment and preventative measures that the organisation will take to reduce harassment. Violence, aggression, and harassment are not acceptable as part of any job. It is also important that every employee feels empowered to report incidents and wherever it occurs and have access to appropriate support.

Conclusion

There is currently widespread harassment and abuse towards employees in the night time economy, leading to personal safety concerns and a lack of confidence in reporting. However, we believe the challenges identified can be overcome.
